Who Can Establish Service
New service can be established by the property owner, an authorized tenant or a property manager under contract from the property owner. All service charges are the responsibility of the property owner and will be secured by the property through general or tax lien in the event of non-payment. A tenant applying for utility service will be required to provide a copy of the lease agreement showing the name of the property owner and applicant and indicating that the tenant is responsible for utility payments. A property manager will need to provide a property management agreement showing the property owner name and indicating the property manager is authorized to establish utility services at the property. All individuals applying for a utility account will need to provide valid government issued identification. Individuals representing business or other legal entities will need to provide authorization documentation showing they are authorized to enter into agreements on behalf of the entity establishing utility service.
Responsibility For Utility Payment
Payment for utility account services are the responsibility of the property owner. Remedies for non-payment under these terms will include liens against the service address property. Liens will be filed individually or processed on the County’s annual property tax roll levy. If the applicant is a tenant, they must be duly authorized by the property owner to open a utility account at the service address. Tenant authorization is documented in the rental agreement provided with the application. The property owner is authorized to receive notices regarding the account usage and payment history for tenants. Property managers, must be duly authorized by the property owner to establish a utility account. Any unpaid balances from a prior owner will accrue to the property and new property owner. When purchasing a property in the service area, you should request account balance information to be provided to your escrow company. Unpaid utility account balances represent liens against the property and should be included in the property sale/purchase.
